Supreme Court Clears Rs 36,000 Crore Redevelopment Of Mumbai’s Motilal Nagar Under C&DA Model

July 29, 2025: The Supreme Court has upheld the Maharashtra Housing and Area Development Authority’s (MHADA) decision to redevelop Mumbai’s Motilal Nagar under the Construction and Development Agency (C&DA) model, dismissing legal challenges from residents’ groups.

A bench comprising Justices Vikram Nath and Sandeep Mehta rejected the special leave petition filed by three parties—Motilal Nagar Jankalyankari Samiti, Motilal Rahivasi Vikas Sangh, and Gaurav Arun Rane. The petition challenged the Bombay High Court’s earlier order, which had approved the redevelopment of 143 acres across Motilal Nagar I, II, and III through the C&DA framework.

Solicitor General Tushar Mehta, representing MHADA, argued that the land belongs to the housing authority and emphasized that the state government had granted the project “special status.” He also noted that securing individual consent from thousands of residents would significantly delay the long-pending redevelopment.

The court acknowledged submissions highlighting that eligible residents would receive 1,600 sq ft of built-up area in exchange for 230 sq ft of existing occupancy, far above the standard entitlement under the Development Control and Promotion Regulations (DCPR).

The project is being undertaken in partnership with Estatevue Private Developers, a subsidiary of Adani Realty. It aims to rehouse approximately 3,700 residents in modern apartments and provide 987 square feet of commercial space per unit. The redevelopment includes infrastructure upgrades and improved public amenities.

Under the C&DA agreement, MHADA will retain full land ownership, while the developer executes the project. The Rs 36,000 crore plan includes 3,372 residential units, 328 commercial spaces, and 1,600 slum tenements to be relocated over seven years.

The entire cost of rehabilitation, infrastructure, and amenities will be borne by the developer, with no financial burden on MHADA.
