Maharashtra Plans Separate Law To Regulate Redevelopment Projects

August 25, 2025: The Maharashtra government’s newly approved Housing Policy 2025 has proposed a separate law to govern redevelopment projects, noting that such projects are currently outside the ambit of the Real Estate (Regulation and Development) Act, 2016 (RERA). The policy, cleared last month, seeks to address the regulatory gap that has left many homeowners without relief in stalled or delayed redevelopment schemes.

While MahaRERA oversees new real estate developments across the state, it has repeatedly clarified that redevelopment projects do not fall under its jurisdiction. The regulator has dismissed several complaints from homeowners in redevelopment cases, advising them instead to approach other competent authorities.

Highlighting the issue, the Housing Policy states, “Due to several reasons, redevelopment projects either do not commence or get delayed, which results in financial, social, and mental distress for the flat owners. Most flat owners are forced to stay in transit camps or take monthly rent from the developer to arrange for accommodation. Many times, the developer stops providing residential rent. Redevelopment projects get delayed for various reasons.”

To safeguard homeowners, the state has proposed a new RERA-like framework specifically for redevelopment. This law is expected to regulate timelines, rental payments, and developer accountability, providing much-needed security to residents affected by redevelopment delays.

The Housing Policy 2025 also introduces targeted measures to revive stalled real estate and slum rehabilitation projects, with a strong emphasis on cluster redevelopment for efficiency and scale. Further, the government has made a significant push for self-redevelopment by housing societies. To encourage this, it has earmarked Rs 2,000 crore and proposed the creation of a dedicated support cell to guide cooperative societies through the process.

Through these reforms, the state aims to streamline redevelopment, ensure accountability, and offer homeowners greater confidence in Maharashtra’s evolving housing landscape.
