The Bombay High Court has reinforced the necessity for obtaining the irrevocable consent of at least 51% of eligible slum dwellers before appointing a developer for slum redevelopment projects. The court stressed that without this mandatory consent, developers with insufficient support could still claim redevelopment rights, potentially causing “serious complications.”
This ruling came during a petition filed by Atlantic Construction Company, which was challenging decisions made by the Apex Grievance Redressal Committee (AGRC) and the CEO of the Slum Rehabilitation Authority (SRA). The orders, dated July 1 and February 5, rejected Atlantic Construction’s bid to redevelop the Sahyog Kalpana CHS in Versova, Andheri (West), a site with 130 structures, 97 of which were eligible for rehabilitation.
