Gateway of India Jetty Project Gets SC Nod As Plea Dismissed

September 2, 2025: The Supreme Court on Monday dismissed pleas challenging the construction of a passenger jetty and terminal facilities near Mumbai’s iconic Gateway of India, effectively upholding the Bombay High Court’s July 15 verdict.

A bench comprising Chief Justice of India Bhushan R. Gavai and Justice K. Vinod Chandran ruled on special leave petitions filed by Laura D’Souza and others, stating that the jetty project had been approved by the competent authorities following due consideration and statutory clearances. “We are not inclined to interfere with the impugned judgement and orders passed by the High Court. The SLPs are thus dismissed,” the bench noted.

The proposed 1.5-acre project, situated roughly 280 metres from the Gateway near the Radio Club in south Mumbai, will include a 150-car parking facility, VIP lounges, waiting areas, ticket counters, administrative offices, and an amphitheatre. The jetty itself is planned in the shape of a large tennis racquet, supported on stilts over the sea.

The Bombay High Court, led by then Chief Justice Alok Aradhe and Justice Sandeep V. Marne, had previously observed that development “is not an affront to the environment when it follows regulations and sustainability guidelines.” The court emphasised that the primary purpose of the project is to facilitate passenger embarkation and disembarkation, while ancillary amenities such as the amphitheatre and cafes are intended only to support this function.

Earlier this year, a Supreme Court bench headed by CJI Gavai had refused to stay the project, directing the High Court to adjudicate the matter expeditiously. Petitioners had argued that approvals were “illegal and arbitrary” and posed a threat to the heritage area. The state government countered that the project followed due legal process and was of public importance, aiming to reduce congestion near the Gateway and enhance passenger safety.

The Supreme Court’s decision now paves the way for the commencement of construction, marking a significant step in the development of Mumbai’s waterfront infrastructure.
