BMC Registers Case Against SRA Developer Over Pothole-Causing Water Dump In Oshiwara

September 25, 2025: The Brihanmumbai Municipal Corporation (BMC) has filed a case against a slum rehabilitation project (SRA) developer in Jogeshwari’s Oshiwara area after allegations surfaced that rainwater from the construction site was being discharged directly onto the road without proper drainage.

Senior civic officials reported that the condition of Oshiwara Udyan Marg had been deteriorating due to recurring potholes. An inspection revealed that the SRA developer undertaking the project along Oshiwara Udyan Marg had been releasing stagnant rainwater from the site via a motor pump, without any measures to channel it into drains. The direct discharge of water onto the road had contributed to erosion and damage, worsening the road surface over time.

In response, the BMC lodged a complaint against the developer at Oshiwara Police Station on Tuesday. Officials stated that the case was registered under Section 125 of the Indian Penal Code and Sections 115(a) and 117 of the Maharashtra Police Act. The project, located along Oshiwara Garden on Swami Vivekanand Marg in Jogeshwari West, is expected to be completed by October 2025.

BMC authorities noted that the potholes caused by the uncontrolled water discharge had previously been repaired at least three times—on August 2, August 23, and September 3—following periods of heavy rainfall. However, the problem resurfaced on Monday after continued rain over the preceding three days, combined with heavy traffic, caused new potholes to appear along the road. The civic body undertook repairs again on Monday to restore road safety and usability.

The incident highlights ongoing challenges in urban infrastructure management, particularly in areas where construction activities intersect with public roads. Officials have urged developers to ensure proper drainage systems are in place to prevent damage and maintain road safety for commuters.
