BMC will pursue these procedures in order to purchase church land in Borivali: High Court

The Right to Fair Compensation and Land Acquisition Act, 2013 mandates the BMC adhere to certain procedures if it want to build a public garden on a portion of a church-owned plot of land in Borivali (W), close to the Mandapeshwar caves.

On June 21, Justices Girish Kulkarni and Arun Pednekar added that BMC “shall not disturb the peaceful possession of the petitioner in any manner whatsoever” up until that point. Fr. Gerald Fernandes, a trustee and parish priest, filed the petition on behalf of Our Lady of Immaculate Conception Church. 1,309 sqm of the 4,732 sqm of property owned by the church are set aside for a garden or park.
