A portion of the members of the Matunga Kapol cooperative housing organization have filed an appeal with the Bombay High Court due to disagreements with Vallabh Developers’ selection to rehabilitate their 84-year-old, run-down structures.
A high court appeal was brought by thirty-seven members of the society contesting the Divisional Joint Registrar’s (DJR) order rescinding Vallabh Developers’ appointment to rehabilitate the co-operative societies’ buildings.
The March plea outlines how certain managing committee members allegedly conspired with unsuccessful developers for “extraneous reasons” to cause the redevelopment project to be delayed, endangering their lives. The 62 residential and commercial units of the community are divided into four wings. Three members, however, each own two units, therefore there were 59 members overall. Seven members later passed away, and none of their heirs were permitted to join. Thus, the plea claimed, there were only 52 members in 2022 at the pertinent time.
On August 14, 2022, a special general meeting (SGM) was called, and the assistant registrar was invited to conduct the election and selection of a developer in accordance with the law. There were 39 members in person at the SGM, and 11 people participated virtually. Of them, 10 members and 28 members voted in favor of Vallabh Developers virtually and physically, respectively.
