Two Workers Fall to Their Deaths; Contractors Face Legal Action

On Tuesday, two different occurrences in the city resulted in the deaths of a painter and a construction worker who were working on a contract basis and fell off under-construction buildings. Due to allegations that they failed to supply the workers with any safety equipment, the contractors have been charged with causing death by negligence in both cases.

In the first instance, a worker named Deepak Rajbhar, 23, from Azamgarh, Uttar Pradesh, died in Matunga after falling from the 28th storey of a building that was still under construction on BA Road. Tuesday about 3:30 p.m., Rajbhar was giving some building supplies to another worker when the incident happened.

According to eyewitnesses, Rajbhar was standing on an iron grill that was improperly fastened to the wall. He suffered serious injuries when the grill broke apart and he plummeted to the 24th level, slamming his head and leg on a parapet wall. After being taken to Sion Hospital, he was pronounced dead.

After learning of the event, Deepak’s 53-year-old father, Rajesh Rajbhar, an electrician from Azamgarh, travelled to Mumbai early on Wednesday morning. He told the authorities that he had spoken to Deepak over the phone about two hours before the incident while he was eating lunch.

In the second instance, 40-year-old Hawiur Rahman Majid Ali perished while painting the exterior wall of an Industrial Society building in Adarsh Nagar, Worli, after falling from the third storey.

Ali, a Bihari by birth, resided in Bandra with his family. His cousin Shafiq Islam, 32, who lives in Nalasopara and works in Santacruz, said that two days before the event, while he was waiting at a junction in Bandra with a buddy, he had been recruited by a contractor.

Around 9.30 a.m. on Tuesday, Ali and two other employees arrived at block 20 in Adarsh Nagar to report for duty. According to eyewitnesses, he was instructed to paint the third-floor building’s exterior walls but was not provided with any safety gear.

Based on a statement by Islam, the Dadar police have registered the contractor, Tushar Enterprises, under section 106 of the Bharatiya Nyaya Sanhita (causing death of any person by doing any irresponsible conduct).
