Bombay HC Clears Regulatory Hurdle For Mahalaxmi’s Turf View Project

The long-standing dispute over the Turf View residential project in Mumbai’s Mahalaxmi has reached another significant stage after the Bombay High Court set aside a MahaREAT order concerning the development.

The High Court’s September 29, 2026 ruling came after the parties involved reached an amicable settlement covering their respective disputes and claims. The decision restores earlier regulatory orders concerning the project’s promoter and registration status.

Originally launched nearly two decades ago as Orchid Turf View, the luxury residential project attracted several high-net-worth buyers in 2007. Many purchasers had reportedly paid around half of the agreed consideration, but later alleged that agreements for sale were not executed, construction remained incomplete and possession was never delivered.

The project subsequently became embroiled in a dispute following changes in development rights and proposals that altered the nature of the development.

MahaRERA had approved a change in promoter in October 2021 and later allowed the project to be de-registered in September 2022. Four allottees challenged these decisions before MahaREAT.

In August 2026, the tribunal overturned the regulatory decisions, reinstated the project’s residential status and questioned the process through which the promoter change had been approved.

The latest Bombay High Court ruling has now reversed that position by setting aside the MahaREAT order. Consequently, the earlier decisions approving the promoter change and de-registration of the project stand restored.

The prime Mahalaxmi site is linked to plans by Prestige Estates and Valor Estate for a proposed residential-cum-commercial development overlooking the Mahalaxmi Race Course. The High Court’s decision removes an important regulatory hurdle surrounding the project.

However, the ruling should not be interpreted as confirmation of an immediate project launch. Details such as the final development configuration, apartment sizes, pricing, construction programme and launch schedule have not yet been announced.

The case also highlights the importance of due diligence for prospective property buyers. Beyond location and developer reputation, purchasers should examine a project’s RERA status, promoter history, approvals and any outstanding or historical litigation before making an investment decision.

For Turf View, the latest court order provides greater regulatory clarity, but the project’s future development will depend on subsequent planning, approvals and execution.
