Maharashtra Moves To Speed Up Deemed Conveyance For 67,000 Housing Societies

Maharashtra is taking steps to speed up the deemed conveyance process for around 67,000 cooperative housing societies that are still awaiting clear ownership rights over their land and buildings.

Deemed conveyance provides housing societies with a legal route to secure ownership of their property when a developer or original landowner has failed to execute the required conveyance deed. The process is particularly relevant for older housing societies seeking to establish clear title before undertaking redevelopment.

The state government is looking to improve coordination among departments dealing with cooperation, revenue, land records and registration to reduce procedural delays and make the process more efficient.

The move could have significant implications for Mumbai’s redevelopment landscape, where several ageing residential societies are exploring redevelopment or self-redevelopment. Establishing legal ownership of the land and building is often an important step before societies can proceed with redevelopment plans.

Faster deemed conveyance could help societies overcome one of the initial hurdles involved in redevelopment. However, obtaining conveyance alone does not guarantee that a redevelopment project can proceed. Societies would still need to secure the necessary approvals, assess the financial and technical feasibility of the project, obtain member consent and comply with applicable legal requirements.

The initiative could therefore provide greater clarity to societies that have remained in a prolonged state of uncertainty over property ownership. For many older buildings, establishing a clear title could help create a stronger foundation for discussions with developers or for exploring self-redevelopment options.

Sandeep Sadh said, “Clear title is the starting point for any serious redevelopment discussion. Speeding up deemed conveyance can help many societies move from uncertainty towards actual redevelopment planning.”

With thousands of cooperative housing societies awaiting conveyance, improved coordination between government departments could potentially reduce the time required to resolve ownership-related issues and allow eligible societies to move ahead with their redevelopment plans.
