The Bombay High Court has mandated that non-consenting members of a housing society must vacate their premises within two weeks or face a fine of rs 5 lakh each.
The court expressed displeasure over the refusal of these minority members to leave, stating that their actions jeopardize the entire redevelopment plan and negatively impact the remaining members. Justice Arif Doctor emphasised that this conduct also has significant financial repercussions for developers, who must begin payments to cooperating members who have already vacated. If the 11 non-consenting members do not comply within the given timeframe, the fine will be divided between the developer and the housing society.
