Bombay High Court Creates Special Bench to Review Slum Redevelopment Law after SC Order

In order to assess a Suo moto Public Interest Litigation (PIL) for conducting a thorough audit of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971, the Bombay High Court constituted a special division bench on Tuesday, August 13, 2024.

In response to a decision rendered by the Supreme Court in the matter of Yash Developers v. Harihar Krupa Co-operative Housing Society Limited, this special bench was established.

A law’s intended application must be confirmed in reality, according to the Division Bench of Justices P.S. Narasimha and Aravind Kumar, which stated as much in its July 31 ruling. If not, figure out why and take swift action.

The Bombay High Court is currently reviewing 1,612 cases under the Maharashtra Slum Areas Act, with 135 of these older than ten years. Over the past 20 years, the court has processed 4,488 cases. Currently, 923 appellate and 738 original cases remain undecided.
