November 11, 2025: The Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed the developer of an Andheri East housing project to repair all structural defects, particularly in common areas, following complaints from the residents’ co-operative housing society.
The directive comes after the society of Vasant Oasis Jolan Building No. 14, represented by advocate Anil D’Souza, filed a complaint citing poor construction quality, leakage in common areas and terrace water tanks, and fungal damage to wooden doors.
According to the complaint, homebuyers had purchased flats between 2011 and 2020, and the project was handed over to the society in early 2021. Residents soon began reporting water leakage and substandard workmanship. Although the developer carried out limited repairs in individual flats and shared spaces, the society claimed the issues persisted.
The developer, however, denied the allegations, arguing that buyers had inspected their units prior to possession and were satisfied at handover. It further stated that any minor defects were addressed voluntarily. The society countered this, saying only temporary repairs were made.
In an order dated September 9, MahaRERA member Mahesh Pathak referred to previous rulings on similar complaints filed by two other societies within the same Vasant Oasis project. Observing that the current society was “similarly placed,” Pathak ruled it was entitled to the same relief.
While the developer claimed to have completed necessary rectifications, MahaRERA noted it failed to produce credible proof of such work. The authority thus directed the developer to fix all structural defects in the building’s common areas and amenities.
On the issue of non-handover of common amenities, MahaRERA held that the demand for immediate transfer was premature and would be addressed at a later stage.
