An occupation certificate (OC) will be granted to the commercial part of a building near Mahim (West) station after more than 27 years. Maharashtra Housing and Area Development Authority (MHADA) has been ordered by the Bombay High Court to “immediately and unconditionally” grant a no-objection certificate (NOC) so that BMC can issue the OC.
The Chief Executive Officer of MHADA was instructed by Justices Mahesh Sonak and Kamal Khata on August 13 to “investigate the entire episode and conduct of officers responsible which resulted in loss to MHADA/public exchequer.”
“Outline measures taken to recover losses from the developer and/or officers responsible” is what the CEO’s affidavit needs to say. In order to “specifically examine the failure” of its officers to bring the situation to the notice of MHADA or HC, BMC is instructed to conduct a “thorough investigation.”
According to the judges’ records, BMC and MHDA have been unduly forcing the petitioners to pay for water supply and sewerage facilities that are either not provided to them or should be recouped from the developer, rather than taking legal action against the developer.
